ONLINE BANKING AGREEMENT AND DISCLOSURE

The following is a copy of The Agreement offered on line as a preface to the Internet Banking Services Enrollment Form:

This Internet Banking Agreement and Disclosure (The Agreement) explains the terms and conditions governing basic Internet Banking Services offered by Mason City National Bank. By using our Internet Banking Services, you agree to abide by the terms and conditions of The Agreement. For clarity, the terms “we”, “us”, “our” and “Bank” refer to “Mason City National Bank”. “You” refers to each person who enrolls for Internet Banking services and has a password.

Your Internet Banking services and each of your accounts are also governed by the applicable Disclosures, Rates and Fee Schedules provided by Mason City National Bank in your deposit and loan agreements given to you when your accounts were established.

Your initial use of Internet Banking Services constitutes your acceptance of and agreement to be bound by all of the terms and conditions of The Agreement by Mason City National Bank, and acknowledges your receipt and understanding of this agreement.


Enrollment
Each person must enroll to have access to his or her accounts. The only accounts accessible are the accounts you are listed as an owner to. If two people are joint owners on all of their accounts and want to share one enrollment with one password, they may do so. If at any time a joint owner becomes an individual owner of a new account or a joint owner with someone else, you should have separate enrollments with separate passwords at that time.

Charges
As a user of the Service, you will not be charged a fee. For other charges applicable to your deposit account, refer to your product brochure.

Online Business Day/Hours of Operation
The Internet Banking Service is available 24 hours a day, seven days a week, except during maintenance periods. Transactions initiated before 2:00 P.M. CST on a business day are posted to your account the same day. Transactions initiated after that time on a business day, Saturday, Sunday or bank holiday, will post on the next business day.

Password and Security
You will be required to change your password the first time you log in to the Internet Banking System. Your password should never be words that can be found in the dictionary or numbers that can be found on other personal documents.  Your password must contain characters from EACH of the following groups:

  • Letters

  • Numerals

  • Symbols, the following are allowed !@#$%^&*?+=~._

The new password is Case Sensitive and must have at least 6 characters. The first character must be a letter or a number.

You will be required to change your password periodically to enhance security. If you forget your password please contact us at 217-482-3246 to have a new temporary password issued. Please safeguard your password and do not, under any circumstances, release it to anyone.

You will also be asked to pick an authentication image and answer several challenge questions.  The challenge questions should be questions only you know the answer to.  Your image automatically appears only when you log in from a computer we already recognize as yours.  If you log in from a different computer, we will ask one of your challenge questions before showing the image and allowing you to log on.  

Liability for Transaction
You are liable for all transactions made or authorized using your password. Do not, under any circumstances, disclose your password by telephone or e-mail to anyone claiming to represent Mason City National Bank. Mason City National Bank employees do not need and should not ask for your password. Do not disclose your password to anyone. If, despite the Bank’s advice, you give your password to anyone, you do so at your own risk. Anyone with access to your Internet Banking password or other means of account access will have full access to your accounts, even if the other person exceeds the authority you intended or agreed upon. Should you believe your password has been compromised, please request that it be changed immediately. You must notify Mason City National Bank that your password has been lost, stolen or otherwise compromised.

You hereby agree to release the Mason City National Bank from any liability and agree not to make any claim or bring any action against us for striving to carry out the requests made through the Internet Banking System under your password. You also agree to indemnify Mason City National Bank and hold it harmless from and against any and all liability (including but not limited to reasonable attorney fees) arising from any such claims or actions.

Mason City National Bank is entitled to act on instructions received through Internet Banking under your password and without inquiring into the identity of the person using the password. Mason City National Bank has no responsibility for establishing the identity of any person using your password.

Our Liability for Failure to Complete Transactions
If a transfer to or from your account is not completed on time or in the correct amount, according to our agreement with you, we may be liable for a portion of your losses or damages. However, the following exceptions apply:

  • If, through no fault of ours, you do not have enough money in your account to make the transfer;

  • If the money in your account is subject to legal process or other encumbrances restricting transfer;

  • If the Internet Banking System was not working properly when you started the transfer;

  • If circumstances beyond our control (such as fire, flood or systems failure) prevent the transfer, despite reasonable precautions that we have taken.

Errors and Questions
In case of errors and questions about your electronic transfers, you should contact us as soon as possible. If you think that your statement is wrong or you need more information about a transfer listed on the statement, you must notify us no later than sixty (60) days after you received the first statement on which the problem or error appeared.

  1. Tell us you name and account number,

  2. Describe the error or the transfer you are unsure about and explain as clearly as you can why you believe there is an error or why you need more information.

  3. Tell us the dollar amount of the suspected error.

We will investigate your complaint and will correct any error promptly.  If we take more than 10 business days to do this, we will recredit your account for the amount you think is in error, so that you will have use of the money during the time it takes us to complete our investigation.

Termination or Discontinuation
You may terminate the use of this Internet Banking Service by contacting the Mason City National Bank in writing. If your account is closed or restricted for any reason, Internet Banking accessibility will automatically terminate.

Computer Requirements
Access to Internet Banking will be provided through the Worldwide Web of the Internet. You are solely responsible for the set up, installation, operation, and maintenance of the equipment you use to access the Internet Banking Service and for providing your own access to the Internet through the Internet Service Provider of your choice. Your browser must support at least 128-bit encryption. We are not responsible for the cost of upgrading your equipment to stay current with the Internet Banking Service. We are not responsible for any errors or failures from any malfunction of your computer and we are not responsible for any computer virus or related problems that may be associated with the use of your computer.

Privacy and Confidentiality
The Mason City National Bank is strongly committed to protecting your security and confidentiality. Account information accessed through our Internet Banking Services is located on a secure encrypted server. To ensure the privacy of your account information while you are online, you are only able to access your account with high security browsers. Once logged in, if no action is taken within 10 minutes you will automatically be logged off. You are limited to a session of 20 minutes each time you access Internet Banking Services. Funds Transfer Limitations
Some of the transfers permitted through Internet Banking Services may be governed by the Electronic Funds Transfer Act (the “EFTA”), and some of the terms and conditions of this Agreement are disclosures required by the EFTA. For example, you can make no more than six (6) transfers from a savings or money market deposit account per month and, in the case of a money market deposit account, no more than three (3) such transfers may be made by check. Fund transfers made using both Internet Banking Services and other transfer methods are counted against the permissible number of transfers. Transfers made in person are not subject to limitation. Commercial account holders are not covered by the EFTA and therefore certain provisions will not be applied to commercial accounts.

Statements
You will be able to view and/or print your account statement through the Internet Banking Services. You are therefore agreeing that this constitutes delivery of your statements to you as provided under the account agreement. In addition to other account activity, these statements will include any transactions authorized using the Internet Banking Service.

Links to Other Sites
Our website may contain links to websites not operated by the Mason City National Bank. We provide these links for your convenience, but we do not review, control, or monitor the materials on any other websites. We do not control, guarantee, endorse or have any responsibility for the content, recommendations, products or services provided by the linked sites. We are not responsible for the performance of those sites or for your business dealings with them. We are not liable for any failure of products and services advertised on those sites. Please use caution when using linked websites, as they may be less secure than the Bank’s website.

Electronic Messaging and Notices
General inquiries concerning maintenance and other issues should be directed to the bookkeeping department at the Mason City National Bank. See the Contact Us link on the Mason City National Bank home page. You should not use this form or regular e-mail to initiate banking transactions or give personal identifying information. This form is not located on a secure encrypted server.

Disclosure of Account Information to Third Parties
We will disclose information to third parties about your account or the transfers you make only in the following situations:

  • Where it is necessary for completing transfers.

  • In order to verify the existence and condition of your account to a third party, such as a credit bureau or merchant.

  • In order to comply with a governmental agency or court orders.

  • If you give us your written permission.

Alterations and Amendments
The terms of this Agreement, applicable fees and service charges may be altered or amended by the Mason City National Bank from time to time. Any use of the Service after the Mason City National Bank posts a change will constitute your agreement to such change(s). Further, the Mason City National Bank may from time to time revise or update the programs, and/or related material, which may render all such program versions obsolete. Consequently, the Mason City National Bank reserves the right to terminate this Agreement as to all such prior versions of the Service, and/or related material and limit access to the Mason City National Bank's more recent revisions and updates of the Service.

Captions
The captions of Sections hereof are for convenience only and shall not control or affect the meaning or construction of any of the provisions for this Agreement.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflicts of law provisions.


Mason City National Bank has the right to deny, modify or terminate this agreement at any time. We will comply with any notice requirements under applicable law for such changes or termination. If we terminate The Agreement, no further Internet Banking transfers will be made. If we modify The Agreement, your continued use of Internet Banking Services will constitute your acceptance of such changes in each instance.
